Welcome to Peak Score Media.
The terms “we,” “us,” and “our” refer to Peak Score Media.
Peak Score Media operates this website and provides educational products, digital materials, study tools, AI-assisted learning features, and related services (collectively, the “Services”).
Our online store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to offer our products and Services.
By accessing or using any part of the Services, or by purchasing a product from Peak Score Media, you agree to these Terms of Service (“Terms”), together with our Privacy Policy and Refund Policy.
If you do not agree to these Terms, you should not access or use the Services.
Please read these Terms carefully before using the Services or completing a purchase.
SECTION 1 – ACCESS AND ELIGIBILITY
By using the Services, you represent that you have reached the age of majority in your jurisdiction or that you are using the Services with the consent and supervision of a parent or legal guardian.
You agree to provide accurate, current, and complete information when making a purchase or creating an account.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
If you become aware of unauthorized access to your account, you should notify Peak Score Media promptly.
SECTION 2 – PRODUCTS AND SERVICES
Peak Score Media provides educational products and services designed to support preparation for the SAT® exam.
Products may include digital study guides, practice materials, study plans, educational resources, AI-assisted learning tools, and related digital services.
The Peak Score System currently includes educational materials together with access to the Peak Score AI SAT Tutor for the access period stated at the time of purchase.
Unless otherwise stated on the applicable product page, access to the AI SAT Tutor is provided for 12 months from the date of purchase.
Peak Score Media may update, correct, improve, modify, or replace portions of its educational materials and Services from time to time.
SECTION 3 – ORDERS, PRICING AND PURCHASES
All orders are subject to acceptance and successful payment processing.
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes or other charges may be added where required.
Peak Score Media may change prices, promotions, discounts, or offers for future purchases at any time.
Changes in price after a completed purchase do not entitle previous purchasers to a refund, credit, or price adjustment, except where required by applicable law.
At present, the Peak Score System is offered as a one-time purchase and does not automatically renew unless expressly stated otherwise before purchase.
All purchases and refund requests are subject to our Refund Policy, which is incorporated into these Terms by reference.
SECTION 4 – DIGITAL CONTENT AND LICENSE
Purchasing a Peak Score Media digital product does not transfer ownership of the underlying intellectual property.
You receive a limited, personal, non-exclusive, non-transferable and revocable license to use the purchased materials and Services solely for your own educational purposes.
Unless otherwise expressly authorized by Peak Score Media, each purchase is intended for one individual student.
You may not share, sell, sublicense, redistribute, reproduce, publicly distribute, upload, publish, or commercially exploit Peak Score materials or access credentials.
You may not make Peak Score materials or Services available to other students or third parties.
SECTION 5 – AI SAT TUTOR
The Peak Score AI SAT Tutor is an educational support tool intended to help students understand concepts, questions, mistakes, and SAT® exam preparation materials.
AI-generated responses may occasionally be inaccurate, incomplete, outdated, or otherwise incorrect.
The AI SAT Tutor should therefore be used as a learning aid and does not replace independent judgment, school instruction, professional educational advice, or official test preparation resources.
Peak Score Media does not guarantee that every AI-generated response will be accurate or error-free.
The student remains responsible for evaluating and appropriately using information provided through the AI SAT Tutor.
SECTION 6 – AI TUTOR ACCESS AND AVAILABILITY
Unless otherwise stated at purchase, AI SAT Tutor access is provided for 12 months from the original purchase date.
Peak Score Media does not guarantee uninterrupted or error-free availability of the AI SAT Tutor.
Temporary interruptions may occur because of maintenance, updates, technical problems, internet availability, security requirements, or circumstances involving third-party technology or service providers.
Peak Score Media may modify the technology, platform, configuration, or technical method used to provide the AI SAT Tutor.
If the existing technical solution becomes unavailable or impractical, Peak Score Media may provide an alternative educational solution with substantially similar functionality.
Reasonable changes to the technology or delivery method do not, by themselves, constitute grounds for a refund.
SECTION 7 – ACCEPTABLE USE
You agree not to misuse the Services or AI SAT Tutor.
You may not use the Services to:
- engage in unlawful, fraudulent, abusive, or harmful activity;
- share access with unauthorized users;
- circumvent technical restrictions or security measures;
- systematically extract, scrape, copy, or reproduce content;
- use automated systems to access or exploit the Services without authorization;
- resell or commercially exploit the Services or generated educational content;
- create or assist in creating competing products through systematic extraction of Peak Score content;
- interfere with, damage, disrupt, or compromise the Services or supporting systems.
Peak Score Media may restrict, suspend, or terminate access where it reasonably determines that these Terms have been violated.
SECTION 8 – ACCOUNT SHARING AND UNAUTHORIZED USE
Your Peak Score access is personal.
Sharing login credentials, digital materials, AI Tutor access, or other restricted resources with unauthorized users is prohibited.
Where Peak Score Media reasonably determines that an account or product is being shared, redistributed, resold, abused, or otherwise used in violation of these Terms, access may be suspended or terminated without refund, to the extent permitted by applicable law.
SECTION 9 – INTELLECTUAL PROPERTY
All original Peak Score Media content, including text, graphics, branding, logos, educational materials, study plans, original practice materials, software-related content, and other proprietary materials, is owned by Peak Score Media or its applicable licensors and is protected by applicable intellectual property laws.
No rights are granted except the limited personal-use license expressly described in these Terms.
Unauthorized reproduction, distribution, resale, publication, extraction, or commercial exploitation is prohibited.
SECTION 10 – THIRD-PARTY TECHNOLOGY AND SERVICES
Certain features of the Services may depend on or interact with third-party technology, platforms, software, hosting providers, payment processors, or other services.
Peak Score Media does not control the continuous availability or operation of third-party services.
Use of certain third-party services may also be subject to the applicable provider’s own terms, policies, technical requirements, or restrictions.
Peak Score Media may change or replace third-party providers or technologies where reasonably necessary to maintain or improve the Services.
SECTION 11 – EDUCATIONAL DISCLAIMER AND RESULTS
Peak Score Media provides educational materials intended to support SAT® exam preparation.
We do not guarantee any specific score, score increase, academic outcome, college admission, scholarship, or other educational result.
Individual results depend on numerous factors, including starting ability, study effort, consistency, preparation time, learning needs, and individual circumstances.
Any examples, illustrations, testimonials, score improvements, or potential outcomes presented through the Services should not be interpreted as a guarantee that every student will achieve the same or similar results.
SECTION 12 – COLLEGE BOARD DISCLAIMER
Peak Score Media is an independent educational provider.
SAT® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, this product or site.
Peak Score Media is not affiliated with, sponsored by, or officially connected with the College Board.
Official College Board materials and intellectual property remain the property of their respective owner.
SECTION 13 – REFUNDS
Purchases and refund requests are governed by our Refund Policy.
Any guarantee, refund eligibility, review procedure, or other refund-related condition is subject to the terms of the Refund Policy in effect as applicable to the purchase.
Nothing in these Terms limits consumer rights that cannot lawfully be excluded or restricted.
SECTION 14 – PAYMENT DISPUTES AND CHARGEBACKS
If you believe there is a problem with a charge or purchase, we encourage you to contact Peak Score Media at info@peakscoremedia.com before initiating a payment dispute or chargeback so that we have an opportunity to investigate and attempt to resolve the issue.
Fraudulent, abusive, or intentionally misleading payment disputes or chargebacks may result in suspension or termination of access to the Services, to the extent permitted by applicable law.
Nothing in this section prevents you from exercising legitimate rights available through your payment provider or applicable law.
SECTION 15 – TECHNICAL REQUIREMENTS
Access to digital products and Services may require a compatible device, internet connection, browser, software, or access to third-party technology.
You are responsible for maintaining the equipment and internet connectivity reasonably necessary to use the Services.
If you experience an access-related problem, contact info@peakscoremedia.com and we will make reasonable efforts to assist you.
SECTION 16 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Third-party services used in connection with the Services may also process information according to their own privacy policies.
SECTION 17 – FEEDBACK
If you voluntarily provide feedback, suggestions, comments, or ideas concerning Peak Score Media or its Services, you grant Peak Score Media a non-exclusive, worldwide, royalty-free license to use that feedback for purposes including improving and developing its products and Services.
This provision does not transfer ownership of your personal information.
SECTION 18 – ERRORS, CORRECTIONS AND UPDATES
We may correct typographical errors, inaccuracies, technical errors, or omissions appearing in the Services.
Peak Score Media may also update educational content to correct errors, reflect changes, improve explanations, or maintain the usefulness of its products.
We do not guarantee that every element of the Services will be error-free at all times.
SECTION 19 – SUSPENSION AND TERMINATION
Peak Score Media may suspend, restrict, or terminate access to the Services where a user materially violates these Terms, misuses the Services, shares unauthorized access, infringes intellectual property rights, engages in fraudulent activity, or creates a security or operational risk.
Termination does not affect provisions that by their nature should continue after termination, including intellectual property, limitations of liability, and other applicable legal provisions.
SECTION 20 – DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Peak Score Media makes no warranties, express or implied, beyond those that cannot legally be excluded.
We do not warrant that the Services will always be uninterrupted, completely error-free, or suitable for every student’s individual circumstances.
SECTION 21 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Peak Score Media will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or relating to the use of, or inability to use, the Services.
To the maximum extent permitted by applicable law, Peak Score Media’s aggregate liability arising from a particular product or transaction will not exceed the amount actually paid by the customer to Peak Score Media for the product or Service giving rise to the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
SECTION 22 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Peak Score Media from claims, losses, liabilities, or reasonable expenses arising from your unlawful misuse of the Services, infringement of third-party rights, unauthorized distribution of Peak Score materials, or material violation of these Terms.
SECTION 23 – SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
SECTION 24 – ENTIRE AGREEMENT
These Terms, together with the applicable Privacy Policy, Refund Policy, and any additional terms expressly presented at purchase, constitute the agreement governing your use of the Services.
SECTION 25 – GOVERNING LAW
These Terms are governed by the laws applicable to Peak Score Media and the relevant transaction, subject to any mandatory consumer protection rights or other laws that cannot legally be excluded.
The applicable governing-law and jurisdiction provisions may be updated when the legal entity operating Peak Score Media is formally established or designated.
Nothing in these Terms deprives consumers of mandatory rights available under applicable law.
SECTION 26 – CHANGES TO PRODUCTS AND SERVICES
Peak Score Media may update, improve, modify, or discontinue features of the Services from time to time.
Where a purchased service includes time-limited access to a material feature, Peak Score Media may replace that feature with a substantially similar solution where reasonably necessary.
These provisions do not limit rights that cannot be excluded under applicable law.
SECTION 27 – CHANGES TO THESE TERMS
Peak Score Media may update these Terms from time to time to reflect changes to its Services, business practices, technology, or applicable requirements.
The updated version will be posted on this website with a revised “Last updated” date.
Changes will apply prospectively as permitted by applicable law and will not retroactively remove rights already acquired by customers where prohibited.
